Welcome to the website for Virigina College, LLC, d/b/a Ecotech Training (“ET”) (the “Site”). Ecotech Training is owned and operated by Brightwood College - El Paso. Your participation in any ET course, and your use of the website or internet site on which it is made accessible (collectively with the ET course, the “Site”), are only on the condition that you agree to abide by the following terms:

BY YOUR AFFIRMATIVE ACT OF CLICKING THE ACCEPTANCE BUTTON, ACCESSING, AND/OR USING THE SITE, YOU ARE SIGNIFYING ELECTRONICALLY THAT YOU AGREE TO ABIDE BY THE TERMS OF THIS END USER AGREEMENT (EUA) AND THE TERMS OF OUR PRIVACY POLICY.

Changes to the EUA

ET reserves the right to change or modify this EUA or any additional terms at its sole discretion at any time. If you do not agree to the modified terms of the EUA for the Site or for any ET course, you should discontinue your participation in the ET course, because your continued participation constitutes binding acceptance of the modified EUA. Therefore, it is important that you read this page regularly to ensure you are familiar with the most updated Agreement. If you do not agree to the changes, you should not continue to use the Site or participate in any ET or service and should instead contact us by emailing ecotechcustomerservice@ecacolleges.com.

Restrictions on Participation

Registration and participation in any ET course is restricted to individuals over 18 years of age. By registering or participating in services or functions on the Site, you hereby represent that you are over 18 years of age. If you do not qualify or do not agree to these terms, you may not use the Site.

Do not misuse the Site or any of the content provided in the ET course. You may not interfere with the presentation or delivery of the ET course or try to access the Site or the ET course using any method other than the interface and the instructions that we provide.

As a condition of accessing the Site, you agree not to (a) reproduce, duplicate, copy, sell, resell or exploit any portion of the Site or the ET course other than as expressly allowed under this EUA; (b) use ET's name, trademarks, server or other materials in connection with, or to transmit, any unsolicited communications or emails; (c) use any high-volume, automated or electronic means to access the Site (including without limitation, robots, spiders, scripts or web-scraping tools); (d) frame the Site, place pop-up windows over its pages or otherwise affect the display of its page; (e) use any manual process to monitor or copy any of the material on the Site or for any other unauthorized purpose; (f) introduce any viruses, Trojan horses, worms, logic bombs or other material which is malicious or technologically harmful; or (g) otherwise interfere with or disrupt the Site or servers or networks connected to the Site, or disobey any requirements, procedures, policies, or regulations of networks connected to the Site.

Intellectual Property

ET courses, and all content or other materials available on the Site, including but not limited to code, images, text, layouts, arrangements, displays, illustrations, audio and video clips, HTML files, and other content, are the property of ET, Inc. and/or its affiliates or licensors, and are protected by copyright, patent, and/or other proprietary intellectual property rights under the United States and foreign laws. Your participation in any ET course does not give you ownership of any intellectual property rights in any of its content.

In consideration for your agreement to the EUA, ET grants you a personal, non-exclusive, non-transferable license to access and use the Site. You may download or copy certain content from the Site only for personal, non-commercial use. You may not commercially exploit content from the Site, nor may you distribute derivative works from the material on the Site. The burden of determining that your use of any information, software, or any other content on the Site is permissible rests with you.

These terms do not grant you the right to use any branding, logos, or technology from ET or as used in any ET course.

Rules for Online Conduct

You agree to use the Site in accordance with all applicable laws. You agree that you will not use the Site for organized partisan political activities. You also agree that you will not e-mail or post any of the following content (“Prohibited Content”) anywhere on the Site:

  • Content that defames, harasses, or threatens others
  • Content that exploits, harms, or attempts to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise
  • Content that discusses illegal activities with the intent to commit such activities, or encourages others to commit such activities
  • Content that infringes or misappropriates another's intellectual property rights, including, but not limited to, copyrights, trademarks, patents, or trade secrets
  • Content that you do not have the right to disclose under contractual confidentiality obligations or fiduciary duties
  • Material that contains obscene (i.e., pornographic) language or images
  • Advertising, promotional materials, or any form of commercial solicitation
  • Content that impersonates or attempts to impersonate another user, person, or entity (including, without limitation, the use of e-mail addresses associated with any of the foregoing)
  • Content that otherwise harms other users or visitors to the Sites
  • Content that is otherwise unlawful or that violates any applicable local, state, national or international law.

Although ET will not routinely screen or monitor content posted by users to the Site, ET reserves the right to remove Prohibited Content of which it becomes aware (though it is under no obligation to do so).

User Accounts

As a condition to using the Site, you may be required to register with ET and select a password and user name (“ET User ID”). You shall provide ET with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of this Agreement, which may result in immediate termination of your account. You may not (i) select or use as a ET User ID a name of another person with the intent to impersonate that person; or (ii) use as a ET User ID a name subject to any rights of a person other than you without appropriate authorization. ET reserves the right to refuse registration of or cancel a ET User ID in its discretion. You shall be responsible for maintaining the confidentiality of your password.

Online Courses

ET and the instructors of its ET courses reserve the right to cancel, interrupt, or reschedule the course or modify the content of any ET course as well as the point value or weight of any assignment, exam, assessment for credit or other evaluation of progress. The Site and the courses and assessment for credit offered on the Site are subject to the Disclaimer of Warranties / Limitation of Liabilities section below.

Terms and Conditions

Should you need to cancel registration for a course, ET will process a full refund including the registration fee, provided we receive notice of your cancellation at least 30 days prior to the original course/exam start date. Cancellations requested less than 30 days prior to the course start date will receive a refund, minus an administrative fee of $250. No refunds will be issued for cancellations received less than 1 week before the course start date, or for those who fail to attend the course for which he or she registered.

ET Course Policies

Web-based Courses and Classes

Web-based courses and classes are only eligible for a refund within 30 days of purchase, and only if the course or class has NOT been completed. Refunds are subject to a $20 Administrative Fee. Archives of web-based courses and classes are available during your course access period.

Attendance Policy for eLearning courses

Attendance and participation have proven to be key factors in accomplishing the learning objectives set forth in your course. Attendance for eLearning is activated through your login and your document-able participation (actively progressing through noted course milestones and progress markers). You have a defined window of time where you have access to the course. You are expected to log in into the Learning Management System and complete the required work noted in the course outline within the specified time period. Failure to do so can result in your course access expiring. In order to successfully complete the program, you must complete all course work and pass the final exam or assessment. Upon completion of the course and all course requirements, students will receive a completion certificate.

Live Class

If you pay for and are enrolled in an upcoming live class, you will have up until 10 calendar days prior to the first scheduled day of class to cancel your enrollment. You will receive a full refund upon the return of unused materials, for up to 30 days after the date of purchase, and only if the class has NOT been completed. All class materials must be returned in original, like-new, resalable condition and in the original packaging and/or shrink-wrap. All associated shipping charges are non-refundable. If you wish to cancel your enrollment within seven (7) calendar days prior to the first scheduled day of class, you will be subject to a $250 administrative fee and you will receive a 50% refund of your enrollment cost.

In the unlikely event that we cancel a class, you will be notified 10 calendar days in advance whenever possible, and you will be eligible for a full refund.

Attendance Policy for Regulated Live Classes

Attendance in our Live Classes is defined as a student physically attending a live classroom on the enrolled/registered dates and times. We track attendance through rosters and sign in sheets. Classroom coordinators or Instructors are responsible for collecting attendance information. The faculty member supervises the attendance process at each class. You are expected to attend the course for which you are registered and to remain in class for its complete duration. 100% live classroom attendance is required to receive a completion certificate for all Solar Training courses.

Upon completion of the course and all course requirements, students will receive a completion certificate.

Reschedules/Transfers

If you need to reschedule (change the date) or transfer (change the location of) your Live Class, please contact our Customer Service department at(800) 450-4684. A class may be rescheduled/transferred up to 10 (ten) days prior to the scheduled start of the class, and four (4) times at no charge, provided you have not attended the class. If your request is within 10 days of your class start date, or after the class has started, you may be subject to a $250 administrative fee. If you transfer/reschedule the same class more than four (4) times in a year, then administrative fees may apply to each subsequent reschedule/transfer.

All reschedule/transfer requests are subject to space availability in the requested class dates. The rescheduled/transferred class must be of the same title as the prior enrollment.

*All program policies are subject to the rules and/or requirements established by individual states. For more information about refund policies in specific states, please see the “Program Policies” section below or check with your state regulatory agency.

Price Adjustment Policy

Discount or pricing adjustment requests must be provided at time of purchase. Discounted pricing cannot be combined with any other offers, coupons, discounts, or promotions. ET reserves the right to correct any incorrect pricing / charges that may have occurred.

Access Period

In general, online access to study materials for ET courses shall be granted for a period of up to two (2) months from the date of purchase. Online access may be less than two (2) months, if limited by state law or changes made at the discretion of ET. Course titles are subject to change without notice.

Extension Policy

You may be able to extend your course access period once at a cost of 25% of that course’s then current retail price. Your extended access would be provided for an additional two (2) months, or the maximum extension period allowed by law. ET reserves the right to deny extensions for courses that are planned for termination. changes made at the discretion of ET. Course titles are subject to change without notice.

ET Pass Guarantee

ET is confident that you will pass your certification exam on your first try. However, in the event that you were unsuccessful in passing your exam, please contact our Customer Service department at (800) 450-4684. You may retake the same class, subject to the conditions described herein, within 6 months of the date purchased. Testing fees are not included.

All enrollments under the Pass Guarantee program are subject to space availability in the requested class. Web-based courses or classes may be substituted for live classes at our discretion. Pass Guarantee retakes are unlimited within 6 months of the date purchased, but you may need to purchase new materials. After 6 months from date of purchase, you will need to re-purchase the materials and/or class and a new Pass Guarantee retake term will begin.

Additional Policies

By visiting the ET site or submitting your personal information to us, you accept the terms described in the Privacy Policy. From time to time we may modify these rules. Your continued use of the ET site after any modification indicates your agreement to the new terms.

Program Policies

All program policies are subject to the rules and/or regulations. For more information about refund policies for students who are called to active military service or in specific states, please see the policies listed below.

Refund Policy for Students Called to Active Military Service

A student of the Institution who withdraws from the Institution as a result of the student being called to active duty in a military service of the United States or the National Guard may elect one of the following options for each program in which the student is enrolled:

  1. If tuition and fees are collected in advance of the withdrawal, a pro rata refund of any tuition, fees, or other charges paid by the student for the program and a cancellation of any unpaid tuition, fees, or other charges owed by the student for the portion of the program the student does not complete following withdrawal;
  2. A grade of Incomplete with the designation “withdrawn – military” for the courses in the program other than courses for which the student has previously received a grade on the student’s transcript, and the right to reenroll in the program or a substantially equivalent program if that program is no longer available, not later than the first anniversary of the date the student is discharged from active military duty without payment of additional tuition, fees, or other charges for the program other than any previously unpaid balance of the original tuition, fees, and charges for books for the program.
  3. The assignment of an appropriate final grade or credit for the course in the program, but only if the instructor or instructors of the program determine that the student has satisfactorily completed at least 90% of the required coursework for the program, and demonstrated sufficient mastery of the program material to receive credit for completing the program.

REFUND POLICY FOR CALIFORNIA STUDENTS

Once you begin the course and withdraw for any reason whatsoever, ET’s refund schedule below will apply, less the enrollment fee.

Calculation of Refund Amount

If you withdraw, or drop out, or are dismissed prior to completing 100% of your course, you will receive a pro rata refund. The last date of actual attendance is used in calculating any refund amount. The refund to be paid to you for your course shall be calculated as follows:

  • Deduct registration and enrollment fees from the total course charges.
  • Divide this figure by the number of days in the course.
  • The quotient is the daily charge for the course.
  • The amount the student owes for purposes of calculating a refund is derived by multiplying the number of days the student attended before withdrawal by the daily charge for the course.
  • The refund is any amount in excess of the figure derived above that the student paid.
  • ET will adjust the refund amount for equipment, if applicable.

If, after the completion of this Refund Policy calculation, a credit balance exists on your account, ET will refund the credit balance to you or another appropriate source within 14 days of the date on which ET performed the refund calculation.

REFUND POLICY FOR INDIANA STUDENTS

Applicants not accepted by ET shall be entitled to a refund of all monies paid.

Withdrawal after Cancellation Period

When any of the following occur, the effective withdrawal date shall be:

  • The date you notify ET of withdrawal or the date of withdrawal, whichever is earlier.
  • The beginning date of any course in which you fail to start the course.
  • The first business day following any 14 consecutive calendar days of absences from the course, if applicable.
  • The date when ET terminates your enrollment.
  • The date you are scheduled to return from a leave of absence and fail to do so.

Cancellation of Enrollment Agreement

ET will refund all payments made if you request cancellation, in writing, to ET within six business days (excluding Saturdays, Sundays and legal holidays) after signing the Enrollment Agreement and prior to starting the course. If you have not visited the ET facility prior to enrollment, you will have the opportunity to cancel the Enrollment Agreement without penalty within three business days either following attendance at a regularly scheduled orientation or following a tour of ET. After this period, the enrollment fee becomes non-refundable.

Refund Policy

All refunds due will be made within 30 days of your effective withdrawal date or cancellation. The last date of actual attendance is used in calculating any refund amount.

If you complete the total hours of the course in less calendar time than that published, the contracted tuition shall be fully earned by ET upon the date of completion, and you will not be entitled to any refund due to earlier completion.

ET will refund 100% of any paid textbooks or equipment/supplies not issued. Any reusable books or equipment/supplies returned to ET in good condition (unused, as determined ET) within 20 days of the withdrawal date will be fully refunded.

In case of prolonged illness, accident, death in the family, or other circumstances that make it impractical to complete the course, a refund that is reasonable and fair to both parties shall be made, but in no event will the amount refunded be less than that reflected in the applicable refund schedule.

Refunds

For students who begin a course and withdraw for any reason whatsoever, ET refund schedule below will apply, less the enrollment fee.

Students Withdrawing Through Completion Of Refund

Prior to the first day of the course: 100% Tuition
On the first day of the course: 100% Tuition
After the expiration of the first day: 10% of the course/90% Tuition
After more than 10%: 25% of the course/75% Tuition
After more than 25%: 50% of the course/50% Tuition
After more than 50%: 60% of the course/40% Tuition
After more than 60%: 100% of the course/0% Tuition

Posting Content on Our Site

You can post content to the Site only if (a) you created and own the rights to the content or you have the owner’s express written permission to post the content; and (b) the content does not infringe any other person’s or entity’s rights (including the copyrights, trademarks, or privacy rights) or violate any applicable laws, this Agreement or any other posted policies. We have the right, but not the obligation, to remove content for any reason.

You are responsible for any content you post to Site and the consequences of sharing or publishing such content with others or the general public. This includes, for example, any personal information, such as your home address, the home address of others, or your current location. WE ARE NOT RESPONSIBLE FOR THE CONSEQUENCES OF SHARING OR POSTING ANY PERSONAL OR OTHER INFORMATION ON OUR SITE.

You may not post content intended to provide professional advice, including the provision of medical treatment, legal advice, or investment advice. You may not post content to solicit, recommend, endorse, or offer to buy or sell any securities or other financial instruments, tout stocks, or recommend that any particular security, portfolio of securities, transaction or investment strategy is suitable for you or any specific person.

Except as otherwise provided in this Agreement, you or the owner of any content that you post to our Site retain ownership of all rights, title, and interests in that content. However, by posting content on the Site, you grant us and our assigns, agents, and licensees the irrevocable, royalty free, perpetual, worldwide right and license to use, reproduce, modify, display, remix, perform, distribute, redistribute, adapt, promote, create derivative works, and syndicate this content in any medium and through any form of technology or distribution. We own all rights, title, and interests in any compilation, collective work or other derivative work created by us using or incorporating your content (but not your original content).

When you use a feature of the Site that allows users to share, transform, readapt, modify, or combine user content with other content, you grant us and our users an irrevocable, non-exclusive, royalty free, perpetual, worldwide right and license to use, reproduce, modify, display, remix, perform, distribute, redistribute, adapt, promote, create derivative works, and syndicate your content in any medium and through any form of technology or distribution and to permit any derivative works to be licensed under these same license terms.

NOTICE OF COPYRIGHT INFRINGEMENT

We respect the rights of all copyright holders, and we have adopted and implemented a policy that provides for the termination in appropriate circumstances of users who infringe the rights of copyright holders. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our designated copyright agent with the following information:

ET will host and provide the ET course and the Site using a commercially reasonable level of skill and care. That said, THE SITE AND ANY INFORMATION, PRODUCTS, OR SERVICES THEREIN ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ET AND ITS PARTICIPATING INSTRUCTORS AND THEIR STAFF (THE “ET PARTIES”) DO NOT WARRANT, AND HEREBY DISCLAIM ANY WARRANTIES, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE ACCURACY, ADEQUACY, OR COMPLETENESS OF ANY ONLINE COURSE, SITE, INFORMATION OBTAINED FROM A SITE, OR LINK TO A SITE.
